Wholesale Disney Character Items from China!

This looks so good, right? Pixar’s Cars 2 truck & car set for just $10 with free shipping from China included.

Or how about The Smurfs? My daughter LOVES Smurfs and will eat up anything that has a Smurf on it! Yes, even this nice looking children’s bedding set with The Smurfs characters on it:

There’s nothing wrong with this, right (other than the eating part I mean)? Everything looks good and you can probably make a nice profit on this item…not so fast! While items with Disney characters, characters from other TV shows or movies, musicians, celebrities etc. are hugely popular on eBay – you need to be VERY careful where you source these products from.

Hint – China is NOT the place to go for such items!

Sites like Ali Express, DH Gate and similar are full of wholesale items that carry some sort of COPYRIGHTED design. It can be:

  • A logo
  • Cartoon character
  • A band / singer image
  • Movie logos / characters (Transformers etc.)
  • And so on

Product like these need to be licensed and can ONLY be purchased from reputable wholesalers in the UK, USA or other countries but NOT from China! Chinese manufacturers simply take these images logos and place them on items WITHOUT paying anything to the licence holder – which is of course illegal.

Don’t be fooled by the low price and how great these items look – it doesn’t matter. It’s illegal to re-sell such items on eBay (or any other marketplace for that matter).

There’s a reason why such items are so expensive from official channels – the license fee these companies pay to manufacture them. So if you’re looking for legitimate Disney character items in wholesale, don’t expect rock bottom pricing, as there’s just no such thing.

The situation with these items is similar to regular branded goods – like stuff made by Sony, Apple or Samsung – margins are extremely small and you have to buy in huge bulk to make profit on eBay.

Okay granted, with these ‘character items’ margins are better compared to iPhones, but still – don’t expect huge profits here, unless you deal with older, out-dated character items.

I hear you say – “but Andrew, eBay is full of such cheap items sourced from China!” That’s very true, I agree, but that doesn’t change the fact that those items are fakes and illegal to sell. I also wish eBay would do more to control this but as you can understand, it’s actually not that easy to do – to verify the legitimacy of millions of items that fall into this category. It’s almost impossible.

On eBay there’s another interesting thing going on – many people sell personalised items with popular bands, TV stars and other famous people on them. I’m talking about products like:

  • T-shirts
  • Mugs
  • Nail stickers
  • Phone cases
  • Birthday cards
  • Etc.

Just do a search on eBay for “One Direction” and you’ll see what I mean.

Here’s the bad news – this is illegal too! You can’t just take an image of One Direction from Google Images, attach it to a mug and start selling!

This will also apply to any logos, Disney characters, movie stars and so on.

To use any such intellectual property (IP), you would have to get written permission from the IP owner – be it a movie studio, band or company. And guess what, they’ll want their cut from any such deal.

Can it be done? I’m sure it can but it won’t be easy, especially for small time traders. Usually IP holders will want a fixed lump sum for you to even start using their design PLUS an on-going fee for each item you sell. There could also be quality control involved on goods you produce, regular reports and so on. NOT EASY!

Does this apply only to images/photos? No! Even if you create a cartoon drawing of Michael Jackson, the same rules apply and you would still have to get permission to use such images on your products.

While eBay is full of people who have been doing this for years without getting caught, don’t think it can’t happen. If you do some research online you’ll find plenty of cases where IP holders sue the seller to get money for all items sold in the past + a fine & court fees.

These are serious crimes and can even land you jail time if you do this on a large enough scale. So just don’t do it!

That’s it for today – not the most positive news I know, but I just thought many of you would be interested to know what’s behind this wholesale Disney character business. If you want to sell such items, go for genuine, licensed stuff to avoid any problems.

      Good question! I’m not 100% sure but I think it should be ok to do, as long as it’s a simple personalisation like putting on a name or something like that on the item.

    I bought toys that looked like disney characters but had disney logos and i noticed home bargains were also selling similar dolls with no disney logos but names of the fairytale characters on the box which must mean these were not disney items and they were called fairytale dolls.
    So as long as no logos are mentioned and dolls are safe is that allowed?

      Hi Tracey,

      I’m not an IP attorney so I can’t give you advice on this issue – IP is very complex issue and it’s not only about the use of Logos – many characters are copyrighted too, if you sell something very similar, even without logos, you can still get into trouble. Many names of such characters are trademarked too.

      So it is a grey area and something I always recommend to stay away from.

    I am an ecommerce trader from India and want to start selling character licenced products imported from Australia (Manufacturer looks to be a genuine manufacturer of these licensed products). My query is
    – Do I need to get a license personally even if the Manufacturer has license?
    – Can I resell these character licensed products in India after importing from Australia?

      Yes, usually you don’t need any special, additional licences but I’m not familiar with local laws in India so your situation may be different to what we have here in Europe.

    Hi Andrew, if i buy a product from someone who is licensed to sell disney items eg party ware.and i use them to cover and/or fill a different item eg boxes ,bags etc would i be breaking the law if i then sold the items at a fair for a small profit that would go to a charity. i do not own a business its my hobbie.

I found all over the internet that you cannot purchase a foreign-produced Disney character mascot and use it in the US for commercial purposes because you would be violating the licenseholder’s copyright. But no where could I find whether you could get one for non-commerical use such as a private party. Is that still illegal?

      Well, no one will put you in jail for it but it is still classed as FAKE product.

      Just like you would purchase fake Nike Air Jordans for example or bootleg DVD.

      They’re copies/fakes and if you buy them, you support fakes industry which is criminal activity basically.

    I find a factory in china and they give me good price. I see on ebay and amazon others selling this item.
    I want to start my business. please may you advice how to be legal in my business.

      No, it’s not legal in 99% cases.

      Some factories in China though “may” have licenses to use these trade marks in their products. You need to ask about this, ask for proof and try to verify that proof of licensing – so you know you’re getting fully legit, licensed product.

    As said, if i buy let’s say Disney products from a licensed seller (in Germany) is legal to sell the products on my physical shop in another EU country without any licenses. Right??

    About the question 2:
    For example.
    I buy a CANON printer from a supplier in Germany. I sell it to my shop in Netherlands. This is legal i think.
    I buy a CANON printer from Netherlands CANON authorized distributor. I sell it to my shop in Netherlands. This is legal also.
    As far as i know, Netherlands(or any country distributor) official distributor cannot stop everyone from import-sell CANON (or any other) products, and say that is the only one who can sell CANON in the whole country.

    So, back to the question, is there a difference with Disney products?? Why and how someone can stop everyone from buying & selling items in a country?? (i mean within EU of course)

      Yes, you’re correct on all points.

      IF you buy Disney products from a licensed seller in Germany, you can of course legally sell them in your shop.

      1. Well, if it’s a genuine/established supplier, they will most likely have some kind of proof for that – that these are genuine/licensed items.

    Very interesting read.

    Here is my drama. I’m in Australia and run a craft market. I have a couple of stallholders that sell hair accessories using “licenced” ribbon. I’m assuming bought off ebay ect considering the products are $2.

    I’m under the belief that she cannot sell these products but looking for something in writing to confirm this. Ive spent the day on the phone and internet and have nothing.

    Any direction where I can look.

      If they’re bought off eBay, most likely they come from China which almost guarantees that they’re FAKES! (un-licensed ribbons).

      So technically yes, these would be illegal to sell.

    Hi Andrew

    I hope that you can help me with this matter. I have been selling Doctor Who TARDIS floor rugs on eBay and Amazon for about two years I get them retail from USA. Recently I was contacted by someone from the Robe Company and was told that they were the manufacturers and licence holder for the rug, and they had given (for £80,000) exclusivity to sell the rug in the UK to a London based shop, and that I had to remove my listings. They also provided a letter from the BBC confirming that they were licensed to manufacture and distribute the rug. Can they do this? Where do I stand legally, we have a few of these in stock with no outlet.

      IF they really do have exclusive selling rights for that product, then yes, they can do that.If that’s true. Not sure how you can fully verify/check that though. There’s always a small chance that competitor is simply playing with you and such letters are one of the easiest way to scare people off from a product. But it could be that it’s genuine…

    I am looking to start up a business with plush toys. However my partner and I have some issues you can help us resolve.

    We looked at your blog and comments, and it appears anything coming from China that has any licences associated to them i.e. Mickey mouse, is not a genuine product. Overall even with the supplier stipulating that the have a licence agreement, it is deemed fake or not legit. Is this true?

    On top of this, we also wish to know is if we contact a wholesaler or supplier regardless of origin and they have the licence, if we buy from them and resell do we have to have the licence to sell them too? i.e. do we need a licence and permissions from the original company whom designed and made them?

    And lastly do you have a site of or do you know where is the best place is to go to contact the licencees. The link to Disney was fab.

      1) Don’t believe what Chinese suppliers tell you on this – in 99% cases they’re lying and they don’t have permission to manufacture and sell those items.

      2) No, if you buy from a genuine, authorised distributor, you don’t need any further licenses.

      3) Not really, no – sorry, I do not work with these items so can’t help with contacts. But you can probably find most companies via Google search.

  15. Hi. I make tutus dresses and have done sleeping beauty inspired dresses etc. Is this illegal? I also but character embroidered patches and attach them to the dresses is this too also illegal? I assumed because there are so many out there doing it that everything would be okay, but surely these embroidered patches should be legally sold?. I mean being a tutu it’s not going to be a replica of the real thing. But never thought about infringing on copyright issues till my brother mentioned it today. Gosh this is all so complicated xxx

      Yes, it is quite complicated so I totally feel you… The fact that everyone else is doing it, doesn’t change the fact that it’s illegal. For example, there are tons of sellers who make clocks, mugs, t-shirts, jewelry using famous band images (like One Direction, Take That etc.) – they just get these images from internet and put on customized products. Many sellers are doing this BUT it’s still illegal!

      You can’t just take an image off internet, character, logo and put it on a product. You need a license from IP rights holder to do so. And it’s not easy to get such a license as usually these large companies won’t deal with small volumes – they will want say a run of 100 000 items for which you pay a fixed fee or % per item sold.

      So yes, while many people are doing this, it’s still illegal and potentially can get you in trouble and huge fines.

However, if I were to buy from a legitimate supplier here in the uk, do I need a licence to sell it on ( I appreciate that the profit margins are minimal)? Also, if I were to buy say material with a Disney print on, can I sell something I have made with it (eg a dress)?

      I’m not an expert in this BUT as far as I know, you don’t need a special licence to sell genuine Disney products. They’re genuine/licensed already, so you should be able to sell them.

      As for using materials to make an item – again, I think if it’s a genuine/licensed material, you can do that. But I’m not 100% sure as I haven’t personally done this.

  17. Hi, just wondering about IP rights and Disney. It’s similar to the person writing about the Minnie muse dress. If I were to buy dresses that look like Disney princess characters but don’t have any Disney logos or images on them, is this illegal…e,g. if it looks similar to a Disney princess dress but not identical and no princess images is this ok or not? And can you advertise as that character…e.g frozen inspired elsa dress..? Or what about just a blue dress with a snowflake on It and a cape? Are either or both of these ok?

      It’s difficult to give any advice on this as I’m not an expert on IP rights, you would need to consult someone who works with this stuff on a daily basis.

      In most cases, if no logos are used and designs are NOT copies, you should be fine. a blue dress with a snowflake on it and a cape is def. ok

      When you sell them, it depends on how eBay interprets your ad – in some cases they’re ok with using brand name + words like made for, compatible with etc. and in some cases you can’t even use the brand name in listing at all.

    Apparently, 99% of people that sell on eBay sell fakes, especially the ones with “Frozen”. It is practically impossible to sell a genuine one on eBay when you have to compete with people who sell fakes for less than half the price of original. It’s not worth it!

      I totally agree with you. This is a huge problem on eBay in several product categories and to be honest, I don’t know how it can be even fixed as in 99% cases customers never even realize that they have bought a fake.

    Again something you may have covered.
    We purchase lanyards,military caps, and blankets in Los Angeles for resale.
    We know the Sports Wholesalers are buttoned down tight in their shops so trust them. The hat importers tell us of the problems they encounter with customs, even having proper paper work The blankets are another story. Many blanket importers sell Disney blankets, they openly display on them store fronts. When asked they say the blankets were licensed and imported legally. knowing of the problems of the hat importers, I tend to trust the blanket sellers. Should these places be trusted?

    So my other question is: where we have our store we were queried as to whether we had a license to sell Disney products. Do we need such a license, and how would we go about obtaining one?

      I don’t know whatever you can trust them or not, I’m sorry but I don’t know. What you can do is ask them for some proof that those are genuine Disney items? A license for example?

      As for your other question – no, to sell Disney products you don’t need any special licenses as long as they’re are genuine, licensed products.

    We are located in Australia.
    My son is collecting the whole 109 sets of 2014 Disney Pixar diecast cars. We have purchased about half of the cars from big supermarkets, like Target, K-Mart, Myer, Big W. We are running out of places to find the remaining ones he needs. We have seen a lot of people selling them on eBay & Gumtree. I am curious as to how we know if the cars are legit or if they are counterfeit. The irony of the situation is that people selling them on these sites & doing it as a business are selling them for a lot more than we paid in the supermarkets.
    On another note, as a side collection, my son has started buying some of the Disney mini adventures cars. We are not able to buy them here is Australia as they are no where to be found. Again, how do I tell if they are real or fake on eBay? What sites are legit? Is Amazon legit?
    We would love to complete the collections & were wondering what places/sites are the ones to go to to get some more cars (at wholesale prices would be a bonus)?
    Any information would be a huge help.

      The only way really to tell is to buy an item and compare it with what you have. Chinese copies usually will have lower quality packaging materials, could have some mistakes in writing and the product itself could also be lower quality (especially fine details).

      Amazon – if the item is sold by Amazon itself, it will be genuine item. But if it’s sold by a marketplace seller, situation is same as with eBay.

      You could probably look for a well known USA based online toys retailer maybe? Then you at least know it will be genuine item.

  21. Hi iv read all above and a bit confused… Is it illegal if i have bought goods from china with pics of brand on for personal use and family gifts only? Will they get stopped at customs if iv only orderd less than 10 of same thing but a few differents products toys clothes etc

    Also if they are countefieght good why cant disney or any brand sue the manufactor in china so they cease produce?

      Hi Rachel,

      As a consumer, you won’t face any legal action even if your goods are seized by customs as you’re not buying these for re-selling. Even if they do hold your goods at customs, you can just say that you didn’t know that these goods are counterfeit (which is true).

      If it’s a very small, low value order, probably it won’t be stopped by customs.

      Brand owners are suing manufacturers all the time but you have to understand that in China, when one company goes down, 10 new ones take their place. It’s a never ending fight and due to Chinese’s government lack of interest in getting this problem fixed, China still remains the number one country for fake/un-licensed goods manufacturing.

      They copy everything! Even cars!

      But as I said, you shouldn’t really be worried as you’re not doing this as a business.

        Also a quickie if you buy a themed ribbon from china and make crafty things and sell them on a stall raising cash for charity is it still illegal?

        And if i did sell a leftover toy as over purchased, if i dont mention disney is it ok then or still illegal

        Sorry for the questions but i spent 6hrs scouring the net yesterday and there seems to be alot of grey areas and as a single mum i dont want to risk itt!

        Low value I mean less than £100 or so, small package. (Chinese will anyway put the value as $10 or something like that on customs declaration).

        If that themed ribbon has Disney characters on it, then yes – that would still be illegal.

        Don’t sell anything from fake goods you receive. Just take this as a learning experience and move on. But don’t sell these goods as they’re ILLEGAL!

    i have a question. If you purchase items from china, that lets say look like a themed dress, for instance a minnie mouse dress, but it does not have the character on it, just a polka dot bottom, black top and 3 circles for the head ears etc.. is it considered intellectual property?
    I am finding a lot of “grey” areas, items with no actual character that i like but could be sold as a “minnie dress” and maybe have a silhouette of head and ears per say.

    i have indeed been importing many different items from china .

    But i am struggling with this intellectual property rights problem

    i am really not to sure on what items you can get from china which are not infringing copyright laws

    been a bit of a problem as i dont wanna waste money on stuff i cant re sell

      First of all, don’t look for such companies in China.

      Secondly – yes, you can pretty much tell when real goods are involved as in 99% these will be sold by reputable, large, established companies who will have no problems providing proof of origin of their products.

      You want to look for UK, USA based companies – wholesalers and distributors with years of experience in this market. Just don’t expect huge margins with these goods as these are basically BRANDED goods and just like any other branded item, carries small profit margins.

  25. Hi Andrew, would like some advice. I recently ordered some clothes from china. These have since been held in customs…. now I have received a notice of seizure for goods. Its states in there that because some items bearing images & characters of disney princess and having swing tags. which has been deemed a copy of copyright material.
    Now I know I won’t get my goods but what do I do now. Do I fill out form and send back? I am a little worried as never had this and will I get a fine.
    Would love to know your advice.

      I don’t know. This has never happened to me as I have always stayed away from counterfeit goods. I’m sure you’ll be fine as long as that order was not huge in size/volume. There should be a phone number on the letter and instructions what you should do next? Chances are you don’t have to do anything but in any case you can just call them and ask.

    I’m looking to re-sell famous super hero characters like batman and sideman shaped and crafted as a USB manufactured from china. The deigns look very cartoonish, and i want to import these to the uk.

    is this possible? if not how do i get to getting a licence?

      Hi Umair,

      If they carry batman or spiderman logos, then I’m pretty sure they’re un-licensed and you can’t import and re-sell those items.

      To get a license – you first need to find out what company/movie studio owns that particular character/design and find for licensing website/info on Google. For example, for Disney, here’s a special website that covers licensing:

    Good reading some of your comments, me and my wife want to set up our own business, I already run a success retail shop in the ski industry and we have a lot of big name accounts like Oakley, O,neill, new era caps etc etc but she doesn’t have a big interest in ski. We want to make use of a small shop that my current business wants to move out of to expand. Anyway we would be really keen on selling children’s bedroom accessories mainly bedding, curtains, small rugs etc with disney characters or similar on. I have be been on alibaba and found a few not many who make child’s bedding, curtains etc with various designs on the price is ok not wonderful we can achieve my usual double up mark up when finished with import charges etc but reading your comments this sounds illegal? I have to wonder how other on ebay sellers etc can sell and quote “real not fake products” on there page selling at a similar price that we would. I’d be interested to know the best way for me to try and get this set up, as the shop is very well positioned next to a very large primary and junior school I we really think we could give this a real go.

      Yes, it’s 100% ILLEGAL to import such character items from China, don’t even think about it! Those are all un-licensed products that can get you in real trouble.

      The fact that people sell them on eBay doesn’t change the fact that they’re un-licensed products.

      You can only get such genuine, legit products from UK/EU/USA based wholesalers, official distributors who deal with licensed merchandise.

        Thanks for your reply, is there a way to get a licence? these wholesalers must get them some where and import themselves. Some china distributors are saying they are the licence holders could this be correct?

        you can get licensed from license holders BUT it’s a complex procedure, expensive and you have to have an established track record and decent buying power.

        If Chinese manufacturer says that they hold a license for say Disney trademarks, they’re simply lying to you.

    GOTTA A QUESTION FOR YOU. NEED TO IMPORT MINECRAFT TOYS AND IN CHINA THEY TELL ME IT IS COMPLETELY SAFE (ACTUALLY THEY ARE PLUSH AND PLASTIC TOYS). MOJANG SEEMS TO BE THE OWNER OF THE TRADEMARK MINECRAFT BUT NOBODY ANSWERS ME THERE.

      Hi Claudia,

      Minecraft is a registered trademark.

      So you can’t import items with Minecraf logos on the them – they’re un-licensed fakes.

      If there are no logos on them, then probably it’s fine as I don’t think they have registered designs on individual characters.(but I’m not 100% sure).

As a wholesaler of Officially Licensed Sports items- NFL, NBA, NHL, MLB etc I can tell you that none of these items are sold from China (are real) The confusion is that many of the items I sell are made in China. However they are all imported to the US by the manufacturers who make them. Therefore a company in China would actually have to buy from a US supplier to get these items. Although I don’t sell sports jerseys, any jersey shipped from China is also fake. The websites you mentioned all sell fakes. Many of these companies contact me via my wholesale site and want to sell me fake goods.

    Myself and fiancé are thinking about setting up an eBay business to bring in some extra cash and to hopefully make a living from so that one of us can work from home to look after the kids(guess you know who that is). We are planning to buy mobile phone accessories(nothing electrical, just phone case, screen protectors, and maybe earphones) for Samsung and iPhone from Aliexpress to get started but we are unsure if these will be OK to sell on eBay.

    What is your take on this? can we buy the iPhone and Samsung stuff or is it illegal.?

      Great to hear you’re planning to start your own eBay business BUT phone cases/covers/screen protectors is not the best niche to get into.

      Mobile phone accessories niche is very competitive and if you can’t buy in true bulk directly from manufacturers on Alibaba, you won’t be able to compete. Even if you do buy at low enough price, how will you get your listings appear in search results when there are hundreds of pages for similar listings?
